Terms and Conditions

1. Services Provided
We offer professional landscaping and snow removal services throughout Ontario, including but not limited to:

• Lawn care, garden design, and maintenance
• Snow plowing and salting for residential and commercial properties
• Seasonal landscaping services

By hiring us, you agree to these Terms and Conditions, which govern our services.

2. Service Scheduling and Availability

• Landscaping Services: Our landscaping services are scheduled based on mutual availability and weather conditions. We strive to provide services on agreed-upon dates, but reserves the right to reschedule due to weather or unforeseen circumstances.
• Snow Removal Services: Snow removal is performed as needed, based on weather forecasts and accumulation. We prioritize safety, and services may be delayed due to extreme weather or other conditions beyond our control.

3. Cancellation and Withdrawal of Services
We reserve the right to cancel or withdraw services at any time due to unforeseen circumstances, including weather conditions, equipment failure, or other factors. If we must cancel services, we will provide notice and, if applicable, reschedule your service at the earliest convenience.

For recurring services (e.g., snow removal during the winter season), you may cancel or modify your service with at least  72 hours' notice before the scheduled service date.

4. Payments and Financial Transactions

• Service Fees: Our fees for landscaping and snow removal services are quoted based on the specific services requested, property size, and any applicable seasonal rates.
• Billing: Payments are due upon receipt of invoice, unless otherwise agreed in writing. We accept payments and all payments are processed securely.
• Late Payments: If payments are not received within 5 days, a late fee of $29 will apply.

5. Customer Responsibilities

• You are responsible for ensuring that the area to be serviced is accessible, free of obstacles, and safe for our staff to perform their work.
• For snow removal, ensure any vehicles or obstructions are cleared from driveways, sidewalks, and other service areas prior to our scheduled service time.
• You are responsible for maintaining your property in a manner that does not obstruct or hinder our ability to provide services.

6. Liability and Limitation of Liability

• Landscaping: We will take all reasonable care while performing landscaping services, but we are not liable for any pre-existing conditions (e.g., poor soil quality, underlying damage).
• Snow Removal: We make every effort to remove snow safely and thoroughly; however, we cannot guarantee complete removal of all snow or ice from surfaces due to weather conditions or other unforeseen factors. We are not liable for damage caused by snow, ice, or salt usage.

We are not responsible for any injuries or damages caused by improperly maintained areas or failure to follow service recommendations.

7. Copyright and Intellectual Property
All content, including designs, plans, and photos created by Levos Landscaping, remain our intellectual property. Any use, reproduction, or modification of our work without prior written consent is prohibited.

8. User Behavior
You agree not to engage in any unlawful or disruptive behavior while using our services. This includes, but is not limited to, hate speech, harassment, or any activity that could interfere with the safety of our staff or the quality of our services.

9. Account Suspension and Termination
We reserve the right to suspend or terminate service to any customer who violates these Terms and Conditions, engages in harmful or disruptive behavior, or fails to make timely payments. Upon termination, all outstanding balances must be settled.

10. Indemnity
You agree to indemnify and hold harmless Levos Landscaping, its employees, contractors, and affiliates from any and all claims, losses, or damages, including legal fees, arising from your use of our services or failure to follow these Terms and Conditions.

11. Amendments
We reserve the right to update or modify these Terms and Conditions at any time. Changes will be effective immediately upon posting to our website or notifying you in writing. Continued use of our services after changes are made constitutes your acceptance of the new Terms.

12. Governing Law
These Terms and Conditions are governed by the laws of Ontario, Canada. Any disputes related to these Terms will be resolved in the courts of Ontario.
